Article 14. Conduct of calculations and crediting of subjects of foreign economic activity
All subjects of foreign economic activity have a right:
- independently to determine the form of calculations on external economic operations among those which do not conflict with laws Ukraine but answer international rules
- directly to take and give trade credits due to own money in operating on territory Ukraine to currency and in foreign currency both scope, and outside Ukraine, independently to make decision in the noted questions
- freely to elect bank-credit establishments which will conduct them currency accounts and calculations with the foreign subjects of economic activity, to use their services, with inhibition here of requirements of laws in force Ukraine
Calculation and credit maintenance of subjects of foreign economic activity is carried out on territory Ukraine by a bank for foreign economic activity Ukraine and уповноваженими by commercial bank and credit institutions, and also foreign and international jars, incorporated in the set order on territory Ukraine.
Crediting of external economic operations is in operating on territory Ukraine to currency and in foreign currency carried out on the basis of agreement and subject to conditions, concerted between creditors and recipients of credits in credit agreements (agreements).
Credits pending clearance of banks, which are given out the subjects of foreign economic activity after the special credit (borrowed) account in operating on territory Ukraine to currency for coverage of money, which are temporally demonetized, provided товарно-матеріальними by values, calculation, transport and/or by товаросупровідними documents. All other credits, except for a calculation, are provided property which belongs to on the right of ownership the debtor, and/or him by unproperty rights.
State crediting of subjects of foreign economic activity and guaranteing of trade credits which get these subjects the state, in To Ukraine carried out through a bank for foreign economic activity Ukraine but other authorized jars.
The terms of the state crediting and guaranteing of trade credits the state are determined credit agreements (by agreements) which consist between the proper subjects of foreign economic activity and bank for foreign economic activity Ukraine.
About the grant of state credits and guarantees made decision a bank for foreign economic activity Ukraine within the limits of state debt of foreign economic activity limitations in operating on territory Ukraine to currency and in foreign currency after the giving of subjects of foreign economic activity and as a result of expert estimation of feasability study of object of crediting and terms of recoupment of credits. A bank is for foreign economic activity Ukraine must reveal to about the decision the bearer of request on a state credit (state guarantee of trade credit) in a monthly term from the day of presentation of the noted request. In the case of absence of afore-mentioned expert estimation of object of crediting a refuse in the state crediting (guaranteing of trade credit the state) of subject of foreign economic activity from the grounds of pointlessness is not allowed.
Size of state credit (state guarantee of trade credit) which is given in operating on territory Ukraine to currency and/or in foreign currency one subject of foreign economic activity during one year, can not exceed 5 percents from the proper annual state debt of external economic operations limitations.
All subjects of foreign economic activity, which allot credit the foreign subjects of economic activity or get credits for them, must during three workings days send in the National bank of Ukraine information about the noted credits (lump sum, currency on the term of credit) in obedience to set the National bank of Ukraine by a form. The national bank of Ukraine can inculcate licensing of receipt of credits in foreign currency the subjects of foreign economic activity from the foreign subjects of economic activity in the case of origin of circumstances, marked at the article 16 of this Law, and licensing of allotting credit, in foreign currency by the subjects of foreign economic activity the foreign subjects of economic activity in the case of origin of circumstances, marked in the article 16 of this Law.
