Article 34. Responsibility Ukraine as the states
Ukraine as the state carries property responsibility in full before the subjects of foreign economic activity and foreign subjects of economic activity for all actions which conflict with laws in force Ukraine and draw losses (lines, side), moral harm these subjects and result in a loss by them benefits, and also for other the actions, including those which regulate foreign economic activity and straight not foreseen in this Law, that draw the noted losses (harm) and result in the loss of benefit, exept for the cases when such actions are predefined the wrong acts of the noted subjects of foreign economic activity and foreign subjects of economic activity.
Ukraine as the state is responsible for actions, marked in this article all property.
The actions of public organs and official officials of these organs are considered actions Ukraine as the states on the whole. The state carries responsibility for them, as marked in this article.
Any subject of foreign economic activity or foreign subject of economic activity has a right to give a lawsuit to Ukraine as the states. The noted lawsuits are a defendant courts Ukraine in accordance with the article 39 of this Law.
The noted lawsuit is given the subjects of foreign economic activity after a mestome them permanent finding or dwelling, by the foreign subjects of economic activity - after the location of public organ and/or official person, that accomplished actions, marked in this article.
Filed action in a general order, certain civilly judicial by a legislation Ukraine. From the name Ukraine as the states in a process come forward public organ and/or official person, indicated in a lawsuit, and/or one of public prosecutors Ukraine.
Ukraine as the state has a right on regress reimbursement of the losses which arose up as a result of accepting a noted claim from the side of public organs and/or official persons due to their property (accordingly balance or own).
